Terms of Service for Elapsed

These Terms of Service ("Terms") govern your use of Elapsed (the "App"), a mobile application built by Jonathan Maurice ("we", "us"). By downloading or using the App, you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

You may not reverse engineer, decompile, redistribute, or commercially exploit the App or any of its components.

2. In-app purchases

The App offers a one-time premium upgrade. Purchases are processed by Apple under the Apple Media Services Terms; we never see your payment details.

Refunds. All refunds are handled by Apple. To request a refund, visit https://reportaproblem.apple.com.

3. Your data

Counter data you create in the App belongs to you. We do not access, view, or modify it. See the Privacy Policy at https://mauricehq.com/elapsed/privacy for details on the limited anonymous telemetry we collect.

4. Disclaimer

The App is provided "as is" and "as available," without warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected. The App is a counter-tracking utility — do not rely on it for medical, safety-critical, or legally significant timing.

5. Limitation of liability

To the maximum extent permitted by law, Jonathan Maurice will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, including but not limited to loss of data, missed reminders, or device incompatibility.

This limitation does not apply to liability for fraud, gross negligence, or anything else that cannot be excluded under applicable law.

6. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate availability of the App, in whole or in part, at our discretion, with or without notice.

7. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising out of or relating to these Terms will be brought exclusively before the courts of the Province of Quebec, sitting in the judicial district of Montreal.

8. Changes

We may update these Terms from time to time. The "Effective date" above reflects the most recent version. Material changes will be communicated via the App or by updating this URL.
